  • Lifestyle Management: personal shopping, wellness arrangements, entertainment bookings, and day-to-day personal assistance

Fairy Service is not a law firm and does not provide legal advice, immigration advice, or legal document preparation. Legal instruments and regulated professional services must be prepared, reviewed, or performed by appropriately qualified independent professionals engaged for the matter.

All Services are subject to availability, seasonality, and the cooperation of Third-Party Providers. Fairy Service does not guarantee the availability of any specific product, property, or experience until a booking is confirmed in writing.

Fairy Service may decline a request that is unlawful, unsafe, outside the agreed scope, inconsistent with professional or supplier requirements, or not reasonably capable of being fulfilled.

5. Eligibility

Our Services are available to individuals aged 18 years or older with legal capacity to enter into binding contracts. By using our Services, you represent and warrant that you meet these requirements and that all information you provide is accurate, current, and complete.

For corporate memberships and business accounts, the individual registering on behalf of the entity represents that they have authority to bind the organization to these Terms.

6. Bookings, Confirmations & Agreements

All service requests must be submitted in writing via email, through our website inquiry form, or by telephone with subsequent written confirmation. A binding Agreement is formed only when:

  • Fairy Service issues a written service proposal, itinerary, or confirmation;
  • The Client accepts the proposal in writing (email reply or signed agreement); and
  • Any required deposit or payment is received and cleared, where applicable.

Quotations and proposals are valid for the period stated in the applicable document and are subject to change if not accepted within that timeframe. Prices are based on information available at the time of quotation and may be adjusted if circumstances change before confirmation.

A booking with a Third-Party Provider may also create a separate contract between the Client and that provider. The provider's fare rules, cancellation terms, conditions of carriage, property rules and other applicable terms are binding on the Client and may limit changes, refunds or special requests.

7. Fees, Payments & Pricing

Fairy Service operates on a fee-for-service and membership basis. Our fee structure is transparent and communicated clearly before any commitment:

  • Concierge Fees: Any service, planning or coordination fee will be disclosed in the applicable written proposal before the Client commits.
  • Membership Fees: The fee, duration, renewal terms, scope and exclusions of an Individual or Corporate membership are defined in the applicable written proposal or membership agreement.
  • Third-Party Costs: All costs charged by Third-Party Providers (hotels, airlines, venues, suppliers) are separate from our concierge fees and are typically payable directly to the provider or through us as your agent, as agreed.
  • Currency: Fees are generally quoted in U.S. Dollars (USD) unless otherwise agreed. Currency conversion fees, if any, are the Client's responsibility.

Payment Terms: Due dates, deposits, payment schedules and accepted payment methods are stated in the applicable proposal, invoice, booking confirmation or membership agreement. Some supplier arrangements require immediate payment or a non-refundable deposit to secure availability.

Supplier Price Changes: Taxes, government charges, currency movements and supplier-imposed changes may affect a quotation before confirmation. After confirmation, changes apply only as permitted by the controlling booking terms and applicable law.

Late Payments: If an invoice is overdue, Fairy Service may pause work or decline additional commitments until the account is brought current. Any late charge will apply only when it was disclosed in the applicable written agreement and is permitted by law.

8. Deposits, Cancellations & Refunds

Cancellation policies vary depending on the nature of the service, the Third-Party Provider's terms, and the timing of cancellation:

  • Concierge Service Fees: Refundability depends on the work already performed and the cancellation terms stated in the applicable proposal or agreement. Fees for work already performed are not refundable unless required by law.
  • Third-Party Bookings: Refunds for hotel stays, flights, events, and other third-party services are governed by the specific provider's cancellation policy. We will communicate these terms at the time of booking. Fairy Service cannot refund amounts that the Third-Party Provider refuses to return.
  • Membership Cancellations: Cancellation and refund terms for a membership are governed by the applicable written membership agreement and any non-waivable legal rights.
  • Force Majeure Events: In the event of circumstances beyond reasonable control, Fairy Service will coordinate with Third-Party Providers regarding any available alternatives, credits, postponements or refunds, subject to their terms and the applicable client agreement.

All cancellation requests must be submitted in writing. The timing of any approved refund depends on the payment method, provider terms and applicable written agreement.

9. Client Responsibilities & Conduct

By engaging Fairy Service, you agree to:

  • Provide accurate, complete, and timely information to enable us to fulfill your requests effectively
  • Confirm that names, dates of birth and other traveler details match the applicable identification and travel documents
  • Have authority to provide information and instructions for every traveler, guest, employee or other person included in a request
  • Respond to inquiries and approve proposals within reasonable timeframes to avoid missed opportunities
  • Comply with all applicable laws, regulations, and Third-Party Provider rules during the course of service delivery
  • Behave respectfully toward our staff, partners, and suppliers
  • Ensure that all travel documents (passports, visas, health certificates) are valid and obtained prior to departure
  • Obtain appropriate travel and health insurance for all bookings
  • Inform us promptly of any changes to your circumstances, preferences, or requirements that may affect confirmed services

Special requests—including adjoining rooms, views, dietary arrangements, accessibility services, upgrades and early or late check-in—remain subject to the provider's availability and are not guaranteed unless the applicable provider confirms them in writing.

Fairy Service may suspend or terminate services if a Client engages in unlawful, abusive, fraudulent, threatening or materially disruptive behavior. Any financial consequences will be determined by the applicable written agreement, work already performed, non-refundable provider commitments and applicable law.

10. Confidentiality & Privacy

Fairy Service operates on a foundation of discretion and trust. Client information is handled in accordance with our Privacy Notice, applicable law, contractual obligations and the information reasonably required to provide the requested services.

We will not disclose, share, or sell your personal information to unauthorized parties, except as necessary to fulfill your service requests (e.g., sharing your name with a hotel for a reservation) or as required by law. For full details on how we handle your data, please review our Privacy Notice.

Clients also agree to respect the confidentiality of any proprietary information, supplier contacts, or internal arrangements disclosed by Fairy Service in the course of service delivery.

11. Third-Party Services & Liability

Fairy Service acts as an independent concierge and coordinator and, where applicable, arranges services supplied by independent providers. We use reasonable care when selecting or working with Third-Party Providers, but we do not own, operate, or control the hotels, airlines, venues, professionals or other suppliers we recommend or engage.

We are not liable for:

  • The acts, omissions, negligence, or defaults of Third-Party Providers
  • Injury, loss, damage, delay, or inconvenience caused by Third-Party Providers or force majeure events
  • Changes to Third-Party offerings, amenities, or standards after booking
  • Discrepancies between Third-Party descriptions and actual experiences

Our liability is limited to the concierge fees actually paid by you for the specific service in question, unless otherwise required by applicable law. We strongly recommend that all Clients obtain comprehensive travel and liability insurance.

12. Intellectual Property

All content on the Fairy Service website — including text, images, logos, designs, itineraries, proposals, and other materials — is the intellectual property of Fairy Service, LLC or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of our content without prior written permission. Custom itineraries and proposals prepared for you are for your personal use only and may not be resold, shared with third parties, or used for commercial purposes without consent.

13. Disclaimers & Warranties

Fairy Service provides its Services on an "as is" and "as available" basis to the fullest extent permitted by law. While we strive for perfection in every detail, we do not warrant that:

  • The website will be uninterrupted, error-free, or completely secure
  • Any specific outcome, experience standard, or result will be achieved
  • Third-Party Providers will meet any particular quality benchmark (though we endeavor to select only the finest partners)

We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Fairy Service, LLC and its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, emotional distress, or reputational harm, arising out of or in connection with your use of our Services or website.

Our total aggregate liability for any claim arising from or related to our Services shall not exceed the total amount of fees actually paid by you to Fairy Service for the specific service giving rise to the claim during the 12 months preceding the event.

Nothing in these Terms shall limit or exclude liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Fairy Service, LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your misuse of our Services or website
  • Your infringement of any third-party rights, including intellectual property or privacy rights
  • Any harm or damage caused to Third-Party Providers during the delivery of Services

16. Force Majeure

Fairy Service shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, war, terrorism, civil unrest, government actions, labor disputes, strikes, utility failures, or significant disruptions to transportation or communication systems.

In such circumstances, we will make reasonable efforts to mitigate the impact on your Services and, where possible, offer alternative arrangements or credits for future use.

17. Governing Law & Jurisdiction

These Terms and any dispute arising from or relating to them shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of laws principles.

Jurisdiction and venue for a dispute will be determined by applicable law and any controlling written agreement between the Client and Fairy Service. No statement on this website changes any venue that cannot lawfully be selected by contract.

18. Dispute Resolution

Before initiating formal legal proceedings, the parties are encouraged to attempt in good faith to resolve the dispute through direct written communication. Either party may pursue remedies available under applicable law or a controlling written agreement.

For qualifying disputes, Fairy Service may, at its discretion, offer mediation or arbitration as a cost-effective alternative to litigation. Participation in mediation or arbitration is voluntary unless otherwise agreed in a separate written agreement.

19. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

20. Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. Fairy Service may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.

21. Entire Agreement

These Terms, together with our Privacy Notice, membership agreements, and any written service proposals or confirmations, constitute the entire agreement between you and Fairy Service regarding the subject matter herein and supersede all prior or contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written.

22. Changes to These Terms

We may update or revise these Terms periodically to reflect changes in our Services, legal requirements, or business practices. The most current version will always be posted on this page with the "Last updated" date. We encourage you to review these Terms regularly.
